Update on Court business as at 7th April 2020

Updated Guidance has been issued by Lord Justice MacDonald in England and Wales on 'The Remote Access Family Court' and can be found here. This only applies to proceedings in England and Wales. In Scotland, all proceedings other than urgent matters are at a standstill, with cases having been sisted (stayed or frozen) for the time being. 'Urgent' is being narrowly defined - see below, from the Coronavirus- Business Update from the Scottish Courts and Tribunals Service published 27th March 2020 for Sheriff Court matters and Guidance Note for Practitioners, from the Court of Session published 25th March 2020, for Court of Session matters).

If you have urgent civil business please contact the appropriate court, from the 10 listed above, to arrange for the case or application to be dealt with.  Urgent business includes: new applications for child protection orders, interim interdicts, child referral appeals, urgent adoptions or urgent interim residence or contact applications, caveats and urgent applications in relation to Adults with Incapacity.

Court of Session: 

With effect from 25 March 2020 only essential Court of Session business
will be dealt with. Essential business is:

- Child abduction petitions
- Applications for interim interdict
- Other urgent matters on cause shown.
