Skype and the Courts- Family cases when the courts are closed

30th March 2020

Alison Edmondson gives her thoughts on the implications for family cases being dealt with by the courts remotely, following a case conducted last week by Skype in E&W. The case concerned whether a man, AF who had suffered a devastating stroke in 2016 and who was being tube fed, had capacity to decide whether to continue to receive medical treatment to provide essential nutrition and fluids. It's one of the first since the COVID-19 pandemic to be conducted by Skype. There has been significant commentary in the legal press in recent days about the process by which the case was determined- both from lawyers and now AF's daughter's supporter, Prof. Celia Kitzinger. You can find Alison's thoughts on Linkedin.
